THE ORIGINAL DOODLEART POSTER DESIGN CONTEST
ELIGIBILITY
The Original DoodleArt Poster Design is a Contest (the “Contest”) open to anyone who has agreed and accepted the Terms of Use, who are the age of majority in jurisdictions where the age of majority is over 18 years and where such Contest is legal (“Contestant”). A Contestant must have legal access to the Internet and means to submit a Poster design of its own creation. Contestants must further abide by the doodleartworld.com website Terms of Service. Violation of the Terms of Service may result in disqualification from the Contest. CONTEST PERIOD The Contest begins at 12:00:00 a.m. Pacific Standard Time ("PST") on August 1, 2012 and ends at 23:59:59 p.m. PST on December 1, 2012 (“Contest Period”). The 1st and 2nd place winners will be announced on December 7, 2012. ALL ENTRIES MUST BE SUBMITTED DURING THE CONTEST PERIOD. Entries submitted before or after Contest Period will not be considered or judged. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. RULES & TERMS FOR ENTRY
Needless to say, you must be the author of the work you submit. DoodleArt World Marketing and Sales Inc. reserves the right to delete submissions that are suspected of infringing on copyrights.
SUBMISSION REQUIREMENTS All Submissions must be the Contestant's original creation, executed solely by the Contestant, and any credits must be limited to the Contestant's name(s) only. Contestants must not cheat; all ideas for any design submitted must be solely the Contestant’s. Your Submission may not have been entered in previous contests, nor won previous awards; Nor may your Submission have been previously published or distributed in any media; Your Submission is intended for a family audience and must, in the sole and unfettered discretion of the Judges, be suitable for a general audience. Your Submission must not contain any claims that are not and cannot be substantiated or that would be false and/or misleading to a reasonable consumer. The content of the Submission must not be subject to the rights of any third parties. Submissions may not promote third party products or services, or incorporate third party intellectual property, including, but not limited to copyright protected software, images, characters, logos, names and trademarks. The Submission may not be offensive or otherwise unsuitable for use, as determined in Judges sole discretion. Any submission of robotic, automatic, or programmed entries, or any entries submitted through other unapproved methods are void. Judges shall not be responsible for reviewing Submissions that are unworkable for any reason. As a condition of participating in this Contest and by submitting an entry(ies), each Contestant agrees to permit DoodleArt to describe, publicize, and link to your Submission for public viewing. By participating in the Contest, you are granting DoodleArt: (1) The right to place links to your Submission for download/viewing on the Contest web site. (2) The right to host your Submission on the Contest web site, as well as provide copies of your entered Submissions for use on magazine cover discs, fan sites, download sites, and other web sites of the judges’ choosing. A Contestant may terminate participation in the Contest upon written notice to Judges prior to the end date. OWNERSHIP AND RIGHTSContestants retain all ownership rights in their Submissions, subject to the licenses of any permitted included content; provided, however, that as a condition of participation, Competitors hereby grant a perpetual, royalty-free, irrevocable, non-exclusive license to DoodleArt World Marketing and Sales Inc. (a) to use, reproduce and publish such Submissions or material in connection with the Competition; (b) to publicly display, and/or feature your Submission and all its content in connection with the promotion of this Competition in all media (now known or later developed); and (c) store your Submission on servers, for marketing purposes, and/or for the promotion of the Contest. You agree to sign any necessary documentation that may be required by DoodleArt World Marketing and Sales Inc. or its designees to make use of the rights you granted above. You also understand and acknowledge that Judges, and/or other Contestants may have developed or commissioned materials similar or identical to your Submission and you waive any claims you may have resulting from any similarities to your Submission. Nothing in these Rules shall be construed as granting you any right or license under any intellectual property right of DoodleArt World Marketing and Sales Inc. (including any rights they may have in any patents, copyrights, trademarks, service marks or any trade secrets) or in the DoodleArt web site, by implication, estoppel or otherwise, except as expressly set forth herein. All federal, state, provincial, and local laws and regulations apply. JUDGING CRITERIA All Submissions, for initial Contest compliance, will be evaluated by qualified Judges and evaluators. In the unlikely event of a tie for any portion of the Contest, the Judges shall break that tie by a round of documented votes. Selected Contestants will be notified on December 7, 2012 PRIZES Prizes will be awarded as follows: As a requirement of receiving a prize, a winning Contestant must provide the high resolution graphics in PDF, SVG, or EPS in order to proceed with the production of the poster. If a Competitor cannot or will not accept a prize, or fails to provide the graphics as requested, within 3 days of notification, then the prize may be forfeited and may be awarded to the next highest scoring Submission. No prize substitution is allowed except at the discretion of the Judges. Contest prize winners and runners-up cannot assign or transfer their prize to another person. If prize cannot be awarded due to circumstances beyond the control of Judges, a substitute prize of equal or greater retail value may be awarded. Prizes will be awarded, subject to the limitations stated in these official rules. Any costs or fees not specifically listed herein are the responsibility of Contest winners and runners-up. Taxes, if any, are the sole responsibility of Contest winners and runners-up. This Contest is void where prohibited or restricted by law, and subject to applicable federal, state, provincial and local laws. REQUIREMENTS OF WINNER/PUBLICITY In the event of a dispute as to authorship of a Submission, Judges reserve the right to disqualify any Submission, Contestant, or winner or runner-up; Judges’ eligibility decisions are final. In addition, Contest prize winners and runners-up will be required to sign and return releases of liability, declarations of eligibility, and where lawful, publicity consent agreements, within fourteen (14) days of acknowledged notification. By agreeing to become Contest prize winners or runner-up, Contestant agrees to the use of his or her name, voice and/or likeness, and entry, for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law. If a selected Contest prize winners or runner-up cannot be contacted, is ineligible (under these rules or due to a failure to comply with any of the other applicable policies, licenses, rules, and terms of service, fails to claim a prize, or fails to timely return the completed and executed releases/agreements as required), prize may be forfeited and an alternate potential winner and/or runner-up may, at Judges’ discretion, be selected. CONDITIONS Contest is subject to these Official Rules. By participating, Contestant agrees: (i) to be bound by these complete Official Rules and the decisions of Judges which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. Judges reserve the right to cancel or suspend the Contest, in its sole discretion, should it receive fewer than 20 entries, or due to circumstances beyond its control, including natural disasters. Judges may cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Judges’ control, corrupt the administration, security or proper play of the Contest. Judges may prohibit a Contestant from participating in the Contest or winning a prize if they determine such entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other contestants or Judges. By participating in the Contest, Contestant agrees that under no circumstances, including, but not limited to, negligence, shall DoodleArt World Marketing And Sales Inc., its and their respective officers, directors, employees, shareholders, agents, successors, and assigns, and all prize providers (the "Released Parties") be liable for any direct, indirect, incidental, special, or consequential damages arising out participation in the Contest, even if any or all of the Released Parties have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you. Judges, Judges’ parent companies, affiliates, subsidiaries, licensors, advertising, promotion, and fulfillment agencies, and legal advisors, and prize providers, and the respective employees, officers, directors, shareholders, agents, and representatives of each, are not responsible for and shall not be liable for: (i) any errors in Contest-related materials, or late, lost, delayed, damaged, misdirected, stolen, incomplete, illegible, or unintelligible, notices, releases, forms, affidavits, or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Judges that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prizes, or acceptance, possession, or use of the prizes, or from participation in the Contest or arising from the entrant's access to and use of the Internet site doodleartworld.com (and all related websites of DoodleArt), including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, to the extent permitted by law; or (vi) any errors in any materials associated with the Contest. Judges reserve the right to cancel, suspend and/or modify the Contest if any problem corrupts the administration, security, or operation of the Contest, as determined by Judges in its sole discretion. Judges reserve the right in its sole discretion to disqualify any Contestant it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Judges reserve the right to seek damages from any such person to the fullest extent permitted by law. Judges’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. PRIVACY By entering the Contest, the Contestant acknowledges that DoodleArt World Marketing and Sales Inc. will collect, process and use the personal data provided by the Contestant in connection with and for the purpose of administering of the Contest. Data about usage of the services will also be collected. DoodleArt World Marketing and Sales Inc. may use third party providers for processing purposes and Judges will ensure that appropriate arrangements are in place with such third parties to ensure that the security of the Competitor’s personal data is adequately safeguarded. DISPUTES The laws of the Province of British Columbia, Canada govern this Contest. As a condition of participating in the Contest, entrant agrees to submit to the personal and exclusive jurisdiction of the courts located within the Province of British Columbia. f any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. The section titles in the Terms are for convenience only and have no legal or contractual effect. WINNERS LIST AND OFFICIAL RULES 1st and 2nd place winners will be posted on the web site www.doodleartworld.com until 90 days after the end of Contest.
